Hotel Rules and Management policies

In Order to make your stay as pleasant as possible, the Management requests your co-operation in observing the following as an agreement between the guest and Stoney Nakoda resort & Casino (hereinafter called 'Management') under which rooms are permitted to be used by the guest(s).

1. Tariff

The tariff is for the room only and is exclusive of any government taxes applicable Meals and other services are available at extra cost. To know your room tariff, please contact the Duty Manager, guest registration forms must be signed on arrivals.

2. Settlement of Bills

Bills must be settled on presentation, personal cheques are not accepted.

3. Right to detain personal effects

In the case of default in the payment of dues by a guest, the management may detain on the premises their luggage and belongings, and be entitled to detain the same and to sell or auction such property at any time without reference to the guest. The net sale proceeds will be appropriate towards the amount due by the guest without prejudice to the management's rights to adopt such further recovery proceedings as may be required. 4. Check-in

Please present your ID card, Passport or Temporary Residence Card upon Check-in. By law visitors must present personal documents for hotel records.

Damage Deposit of up to $500.00 CAD will be required through valid credit card or cash payment. Deposits will be returned after departure and verification of room condition

Visitors must be registered at the front desk and may be required to present valid identification. Registered guests are responsible for the conduct of their visitors at all times.

5. Departure

Check out time is 11:00 am please inform the reception if you wish to retain your room beyond this time. The extension will be given depending on the availability. If the room is available, the normal tariff will be charged. On failure of the guest to vacate the room on expiry or period the management shall have the right to remove the guest and his/her belongings from the room occupied by the Guest.

6. Luggage Storage

Subject to availability of the storage space, the guest can store luggage in the luggage room, at the guest's sole risk as to loss or damage from any cause, Luggage may not be stored for a period of over 30 days.

7. Guest's Belongings

Guests are particularly requested to lock the door of their rooms when going out and going to bed. For the convenience of the Guest, electronic safes are provided in the room to store any valuables.

The Management will not in any way whatsoever be responsible for any loss / or damage to the Guest's belongings or any other property from either the hotel room or the room safe or any other part of the hotel for any cause whatsoever including theft of pilferage.

8. Pets

Pets are allowed in a limited amount of rooms with a fee of $30 per night per pet. No more than Two (2) pets are allowed in a room. Pets found in non-designated pet rooms without the consent of management will be subject to a $250 damage / cleaning fee

9. Hazardous Goods

Bringing goods and/or storing of raw or exposed cinema films, or any other article of a combustible or hazardous nature and/or prohibited goods and/or goods of objectionable nature is prohibited.

The Guest shall be solely liable and responsible to the management, its other guests, invitees visitors, agents and servants for all loss financial or otherwise and damage that may be caused by such articles or as a result of the guests' own negligence and non-observance of any / instructions.

Gambling, contraband, prostitution, weapons, explosives, flammable objects, poisons, drugs, and pungent food are strictly prohibited on hotel premises.

10. Damage to Property

The guest will be held responsible for any loss or damage to the hotel property caused by themselves, their guests or any person for whom they are responsible. Cost of recovery will be deducted from damage deposit. If amount of cost of damage exceeds damage deposit amount received the balance will be added to the credit card on file.

Smoking in hotel rooms is strictly prohibited and guest will be charged a cleaning fee of $500.00 and subject to removal by management

Cannabis consumption is only permitted in designated areas. Smoking or vaping cannabis inside guest rooms is subject to the same penalties as tobacco smoking.

11. Management's Rights (Guest Behavior)

It is agreed that the guest will conduct him/ herself in a respectable manner and will not cause any nuisance or annoyance within the hotel premise. Social Disruption including but not limited to will not be tolerated:

a) illegal activities

b) public intoxication

c) fighting

d) excessive noise (quiet hours are 11:00pm – 7:00am)

e) smoking in hotel rooms

f) vandalism, property damage or theft of company property

g) abuse of guests or staff

The Management has the right to request any guest to vacate his/her room or other areas of the hotel forthwith, without previous notice and without assigning any reason whatsoever, and the guest shall be bound to vacate when requested to do so. In case of the default, the

Management has the right to remove the Guest luggage and belongings from the room occupied by him/her.

Management reserves the right to enter guest rooms for housekeeping, maintenance, or safety reasons, even in the absence of the guest.

Management reserves the right to refuse service or accommodation to any individual at its discretion, in accordance with applicable laws.

12. Children

As the parents, guardians, or chaperones of children aged 12 and under, you are personally and legally responsible for, and must supervise them at all times. For safety reasons, please do not leave children unattended in guest rooms or allow them to roam the hotel property unsupervised.

13. Alcohol Policy

Registered guests of legal age who choose to bring their own alcohol beverages must consume those in their room. Alcohol is not allowed in public areas such as they lobby, halls, etc.

14. Damage and/or theft of Hotel Property

You are liable for any damage caused (whether by the deliberant, negligence, or reckless act to the room (s), hotel's premises or property caused by you or any person in your party whether or not staying at the hotel during your stay. Management reserves the right to retain your credit card and/or debit card details as presented at registration and charge the credit /debit card in such amounts as it shall in its sole discretion deem necessary to compensate or make good the cost or expenses incurred or suffered by property as a result of the aforesaid. Should this damage come to light after the guest has departed, we reserve the right and you hereby authorize us to charge your credit or debit card for any damage incurred to your room or the Hotel property during your stay, including and without limitation for all property damage, missing or damaged items, smoking fee, cleaning fee, guest compensation, etc. We will make every effort to rectify any damage internally prior to contracting specialist to make the repairs, and therefore will make every effort to keep any costs that the guest would incur to a minimum.

15. Damage Discovered After Check-out

Guest Rooms found with waste scattered around, in complete disorder, and/or "trashed" will be subject to a $250.00 maintenance deep cleaning fee, administration fee and/or third-party fees.

16. No-Cooking, Cooking Appliances, Combustibles, and or Fireworks

The safety of our guests, staff, and this facility is extremely important to us. Except for the refrigerator units that the hotel provides, preparation of food in guest rooms by any type of cooking appliances is prohibited. A minimum fee of $250.00 will be charged for cooking in a room, including, but not limited to coffee makers, hot plates, toaster ovens, water heaters, rice cookers, combustible, open flame, barbecue grill, burners, heating appliance or any other item intended for cooking. Open fires, flames or cooking grills, either charcoal or gas, and fireworks are not allowed anywhere on hotel property. All these items will immediately be removed by our staff.

17. Firearms and Weapons

The safety and security of our guests and staff is extremely important to us. No Firearms or Weapons cannot be stored in the hotel premises. Exempted from this policy are law enforcement officers and designated military personnel who are on-duty and required to carry firearms in the performance of their duties.

18. Relation between Management and Guest

Nothing hereinabove shall continue or be deemed to constitute, or create any tenancy or sub- tenancy, or any other right to interact in the hotel premises or any part or portion thereof, in favour of any Guest or resident or visitor, and the Management shall always be deemed to be in full and absolute possession of the whole of the hotel premises.

19. Government rules and regulations and application of laws

Guests are requested to observe, abide by conform to and be bound by all applicable acts and laws and Government rules and regulations in force from time to time.

20. Photographs and Videos

Using photographs and video's taken in the hotel for commercial or public purposes is illegal. Those who do so will be subject to prosecution.

Penalties for Disturbance

(1) In this section, “disturbance” means a disturbance of the peace and quiet of the occupants of an inn by fighting, screaming, shouting, singing or otherwise causing loud noise.

(2) A person who

(a) causes a disturbance in an inn and, having been requested by the innkeeper or the innkeeper’s agent to desist, continues to cause or again causes a disturbance, or

(b) having caused a disturbance, fails to leave the inn forthwith after being requested to do so by the innkeeper or the innkeeper’s agent, is guilty of an offence and liable to a fine of not more than $500 or to imprisonment for 6 months or to both.

(3) An innkeeper or an agent of an innkeeper who

(a) knowing of a disturbance in the inn, fails to request the person causing the disturbance to desist, or

(b) having made that request and in the case of a continuation or recreation of a disturbance, fails to request the person causing the disturbance to leave the inn forthwith,

is guilty of an offence and liable to a fine of not more than $500 or to imprisonment for 6 months or to both.

Parties and gatherings that exceed registered occupancy or create noise disturbances are strictly prohibited. Violation may result in immediate eviction without refund and additional charges.

Arrest without Warrant

10 A peace officer who finds a person committing an offence under section 9(2) or who has reasonable and probable grounds to believe that a person has committed an offence under section 9(2) may arrest the person without a warrant.

Section 7 INNKEEPERS ACT Chapter I-2

Liability of innkeeper

7 An innkeeper is not liable to make good to the innkeeper’s guest any loss of or injury to property brought to the innkeeper’s inn, except

(a) when the property has been stolen, lost or injured through the willful act, default or neglect of the innkeeper or the innkeeper’s servants,

(b) when the property, other than a vehicle, has been expressly delivered for safe custody to the innkeeper, but the innkeeper may, if the innkeeper thinks fit, require as a condition of the innkeeper’s liability under this clause that the property be deposited in a box or other receptacle and fastened and sealed by the person depositing it, or

(c) when a vehicle has been expressly delivered into the custody of the innkeeper for storage or parking in a place specifically reserved and designated by the innkeeper for the storage or parking of vehicles, in which case the liability of the innkeeper for the vehicle and its contents is that of a bailee for reward.
